This Privacy Policy (“Policy”) explains how CBW FINANCE LLC (“we,” “us,” or “our”) collects, uses, shares, and protects personal information when you use CBW-Cash — our mobile application, this website, and related services (together, the “App”).
CBW FINANCE LLC is not a lender. The App is a loan-matching and lead-generation service. We collect information you provide and share it with third-party lenders and partners who may contact you with offers.
By using the App, you confirm that you have read and agree to this Policy. If you do not agree, stop using the App.
We follow applicable U.S. privacy and consumer-protection laws, including:
- Gramm-Leach-Bliley Act (GLBA)
- California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA)
- Fair Credit Reporting Act (FCRA)
- Federal Trade Commission (FTC) rules and guidance
- CAN-SPAM Act and Telephone Consumer Protection Act (TCPA)
- Other applicable federal and state privacy laws
Some rights in this Policy may not apply to information governed by GLBA or FCRA. This Policy applies to U.S. residents aged 18 and older who use the App.
1) Information We Collect
We collect information in three ways: from you, automatically from your device, and from third parties.
1.1 Information You Provide
When you use the App, you may provide:
- Personal identifiers — full legal name, date of birth, email address, phone number, and full residential address (street, city, state, ZIP).
- Government identification — Social Security number (SSN), driver’s license number and issuing state, or similar ID for identity verification and fraud prevention.
- Financial and employment information — employer name and phone, employment status and job title, monthly or annual gross income, income source, bank account number, bank routing number, bank name and account type, and loan purpose.
- Login and security information — usernames, passwords, PINs, and one-time passcodes (stored using encryption).
- Communications — messages, documents, or uploads you send to support.
- Consents — electronic signatures, checkbox confirmations, and acknowledgments.
1.2 Information Collected Automatically
When you use the App, we automatically collect certain technical and usage information, including:
- Device & Technical Data – IP address, device model, operating system, mobile carrier, app version, language settings, and diagnostic / crash logs.
- Usage & Analytics Data – pages or screens you view, clicks and navigation paths, session duration, timestamps, and referral sources.
- Approximate Location – derived from your IP address or similar signals, mainly for fraud detection and to apply state‑specific eligibility and compliance rules.
- Cookies, SDKs & Similar Tools – used for authentication, security, session management, preferences, and analytics. You can limit some of these technologies through your browser or device settings, but certain features may not work properly if disabled.
1.3 Information from Third Parties
We may also obtain information about you from:
- Identity & Fraud‑Prevention Vendors – to help confirm your identity, address, and income, and to detect or prevent fraud, sanctions risks, and other abuse.
- Financial Partners – including lenders, banks, loan platforms, servicers, and payment processors that participate in providing or servicing financial products you request.
- Credit Bureaus & Alternative Data Sources – where permitted by law and, when required, with your consent, to help evaluate eligibility and risk.
- Lead and Marketing Partners – who may refer you to the App or vice versa.
- Public Records & Government Sources – as necessary for compliance, verification, and risk management.
2) How We Use Your Information
We use the information we collect for purposes such as:
- Operating the App – creating and managing accounts, providing core features, processing your requests, and maintaining our services.
- Identity Verification & Fraud Prevention – performing KYC/AML checks and monitoring for suspicious activity, unauthorized access, and security incidents.
- Loan matching — sharing relevant information with lenders and partners so they can evaluate your request and present offers.
- Payments & Funding – facilitating disbursements, repayments, and other payment‑related activities through payment processors and financial partners.
- Customer Support & Communications – responding to your questions, sending confirmations and legally required notices, and delivering important service or security updates.
- Analytics & Product Improvement – monitoring performance, fixing bugs, understanding how users interact with the App, and developing new features or services.
- Legal, Compliance & Risk Management – recordkeeping, audits, regulatory reporting, responding to lawful requests and legal process, and enforcing our Terms of Use.
- Marketing & Educational Content (Where Permitted) – sending you optional communications about features, updates, or offers, consistent with your preferences and applicable law.
3) Legal Basis for Processing
Depending on context and applicable law, we process personal information based on:
- Your consent — where required, including for certain marketing communications.
- Contractual necessity — to provide matching services you request.
- Legal obligations — such as KYC/AML rules and recordkeeping.
- Legitimate business interests — fraud prevention, security, and service improvement.
4) How We Share Information
We share personal information only as needed to operate the App, meet legal requirements, and fulfill the purposes in this Policy.
4.1 Service Providers
We work with carefully selected vendors that perform services on our behalf, such as:
- Hosting and cloud infrastructure
- Data storage and backup
- Identity verification and fraud prevention
- Customer support and communication tools
- Security monitoring and incident response
- Analytics and performance measurement
- Payment processing
These providers may access personal information only to perform services for us and must protect it under contractual obligations.
4.2 Financial Partners and Lead Buyers
When you submit a loan or cash-advance request, we share information with participating lenders, financial institutions, marketing partners, and other buyers so they can evaluate your eligibility and present offers. This may include your name, contact details, SSN, driver’s license, bank account and routing numbers, employer and income information, and loan purpose.
After we share your information, the recipient’s privacy policy governs how they use it. Review each partner’s privacy notice before accepting any product.
4.3 Compensation for Data Sharing
We may receive referral fees, per-lead fees, revenue share, or other valuable consideration when you are connected with a lender or obtain a product through a partner. This compensation may affect which partners receive your information first or how offers are ordered or displayed.
4.4 Sale and Sharing Under State Privacy Laws
Under the CCPA/CPRA and similar state laws, transferring personal information to third parties for valuable consideration may be considered a “sale” or “sharing.” We engage in this type of transfer as part of our lead-generation and matching business.
California residents and others with applicable rights may opt out of the sale or sharing of personal information by emailing [email protected] with the subject line “Do Not Sell My Information.” We will process opt-out requests within 15 business days. Opting out stops future sales but does not delete information already shared with buyers.
Opting out of marketing emails or texts does not opt you out of data sales unless you also submit a separate “Do Not Sell” request.
4.5 Legal, Regulatory and Safety
We may disclose information to courts, regulators, law‑enforcement agencies, government authorities, or other third parties if we believe in good faith that such disclosure is:
- Required by law, regulation, legal process, or governmental request
- Necessary to protect the rights, property, or safety of CBW FINANCE LLC, our users, our partners, or the public
- Needed to investigate, prevent, or respond to suspected fraud, abuse, or security incidents
4.6 Business Transactions
If CBW FINANCE LLC is involved in a merger, acquisition, reorganization, financing, or sale of all or part of its business, personal information may be transferred to another entity, subject to privacy protections that are the same as or materially similar to those described in this Policy.
4.7 With Your Permission
We may share information when you ask us to or give your consent.
5) Data Retention
We retain personal information only as long as reasonably necessary for the purposes described in this Policy, for as long as your account is active, and as required by law (for example, financial recordkeeping, audit, and tax requirements). After applicable retention periods expire, we will delete or de‑identify the information.
Typical retention periods may include:
- Account & Servicing Records – generally for the life of your relationship with us plus a period (often up to 7 years) for legal, audit, and operational purposes.
- Compliance & Risk Records – typically 5–7 years, or longer if mandated by law or regulatory guidance.
- Marketing & Communication Records – generally up to 3 years after your last interaction with us or until you opt out.
- Log & Analytics Data – usually maintained for about 12–24 months to support security and performance monitoring.
Specific retention periods may differ depending on the type of data and applicable law.
6) Data Security
We use administrative, technical, and physical safeguards designed to protect personal information. These measures include TLS encryption for data in transit, AES-256 encryption for data at rest where applicable, role-based access controls, system monitoring, and vendor security requirements.
No internet transmission or storage method is completely secure. You are responsible for protecting your account credentials and notifying us at [email protected] if you suspect unauthorized access.
7) Your Privacy Rights
Depending on your state of residence and the type of information involved, you may have certain rights regarding your personal information, including:
- Access – to request confirmation of whether we maintain personal information about you and obtain a copy in a reasonably portable format.
- Deletion – to ask us to delete certain personal information, subject to legal and business exceptions (for example, where data must be retained for compliance).
- Correction – to request that we correct inaccurate personal information we maintain about you.
- Portability – to receive certain information in a format that allows you to transmit it to another entity, where required by law.
- Opt‑Out Rights (Where Applicable) – such as the right to opt out of “sale,” “sharing,” or certain automated decision‑making or profiling, noting that GLBA‑covered financial information is often exempt from those provisions.
We will verify your identity before responding to certain requests and may deny or limit a request where permitted by law (for example, if fulfilling it would adversely affect others or conflict with legal requirements).
7.1 How to Submit a Privacy Request
To exercise your privacy rights or to ask questions about them, you may contact us at:
- Email: [email protected]
- Subject line: “Privacy Request”
Please include your full name, state of residence, and a brief description of the request (for example: access, deletion, or correction).
You may also be entitled to designate an authorized agent to act on your behalf where state law provides for that option.
8) Marketing Choices
Email. You may opt out of marketing emails using the unsubscribe link in each message. Processing may take up to 10 business days. You will still receive service and legal notices.
SMS. Reply STOP to opt out of marketing texts. Reply HELP for help. Message and data rates may apply. STOP does not affect one-time verification codes.
Push notifications. Manage these in your device settings.
Phone calls. To opt out of marketing calls, email [email protected]. Consent to marketing is not required to use the App or submit a request.
9) California Residents (CCPA / CPRA)
If you are a California resident, you have the following rights under the CCPA as amended by the CPRA:
- Right to Know — what we collect, sources, purposes, and categories of third parties who receive it, including that we sell or share data with lender and marketing partners.
- Right to Delete — subject to legal exceptions.
- Right to Correct — inaccurate personal information.
- Right to Opt Out of Sale/Sharing — email [email protected] with subject “Do Not Sell My Information” or use in-app settings where available.
- Right to Limit Sensitive Personal Information — for SSN, driver’s license, and bank data beyond CPRA-permitted uses.
- Right to Non-Discrimination — we will not deny service solely because you exercised your rights.
Submit requests to [email protected] with subject “California Privacy Request.” We aim to respond within 45 days. GLBA and FCRA may limit some rights for certain financial data.
10) Do Not Track and Global Privacy Control
We do not respond to browser “Do Not Track” signals because there is no uniform industry standard.
If you send a Global Privacy Control (GPC) signal on our website, we treat it as an opt-out of sharing for cross-context behavioral advertising for California residents, where applicable.
11) Children’s Privacy
The App is intended for adult users only. You must be at least 18 years old (or the age of majority in your state) to use the Services or request financial products.
We do not knowingly collect personal information from children under 13. If we discover that we have collected information from a child under 13, we will take reasonable steps to delete it as soon as practicable.
If you believe a child under 13 has provided information to us, please contact us at [email protected].
12) Cookies, SDKs & Similar Technologies
We use cookies, mobile SDKs, and comparable tools to support login and session management, protect the App, remember preferences, and analyze usage.
You can adjust cookie and tracking settings in many browsers and devices. However, disabling certain tools may limit or break some App features (for example, remaining signed in or seeing updated information).
13) Third‑Party Websites & Services
The App may contain links to, or integrate with, websites, apps, or services operated by third parties (such as lenders, banks, credit bureaus, identity‑verification vendors, or analytics providers).
Those third parties have their own privacy practices and policies. We are not responsible for their independent practices, and we encourage you to review their privacy notices before providing them with personal information or using their services.
14) GLBA & FCRA Notices
Some of the information we handle is “nonpublic personal information” subject to the Gramm–Leach–Bliley Act (GLBA). When GLBA applies, our GLBA privacy notice (if provided separately) governs that information and may supersede or limit certain rights described in this Policy.
If we obtain or share information with consumer reporting agencies, or otherwise use “consumer reports” or “credit reports,” your rights under the Fair Credit Reporting Act (FCRA) apply. Where applicable, we will provide any required disclosures about such use.
We do not initiate hard credit inquiries without your express prior authorization. We will clearly disclose if and when a hard inquiry may occur.
15) International Use & Data Transfers
The App is designed for and directed toward users in the United States. If you access the App from outside the U.S., you understand that your information will be transferred to and processed in the United States, where privacy and data‑protection laws may differ from those in your home jurisdiction.
By using the App, you consent to this transfer and processing.
16) Updates to This Policy
We may revise this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. When we make material updates, we will:
- Update the “Effective Date” at the top of this page; and
- Provide additional notice within the App or via email where required by law.
Your continued use of the App after the updated Policy becomes effective means you accept the revised Policy. If you do not agree to any change, you should stop using the App and may request that we delete your account where permitted.
